Terms of Service

The agreement between you and Primal Defense LLC.

These Terms of Service (the “Terms”) govern your access to and use of Primal (the “Game”), our website at primalps.org, and any related services operated by Primal Defense LLC (“we”, “us”, or “our”). By creating an account, downloading the client, or making a purchase, you agree to these Terms. If you do not agree, do not use the Game.

Primal is intended for players aged 18 and over. By using the Game you confirm that you are at least 18 years old and legally able to enter into this agreement.

1. Your account

You are responsible for everything that happens on your account, including keeping your password secure. Do not share your account, sell it, or transfer it to anyone else. Tell us at stars@primalps.org as soon as you suspect unauthorised access.

We may suspend or terminate an account that breaches these Terms. Where we can do so reasonably, we will tell you why.

2. Rules of conduct

While using the Game you agree not to:

Use bots, macros, automation, or any third-party program that gives an unfair advantage
Exploit bugs rather than reporting them, or knowingly benefit from another player doing so
Buy, sell, or trade accounts, in-game items, or in-game currency for real money outside the Game
Harass, threaten, impersonate, or abuse other players or staff
Attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to our servers or services
Use the Game for anything unlawful

Breaking these rules can result in a warning, a mute, a temporary suspension, or a permanent ban, depending on severity and history.

3. Virtual items and purchases

The Game offers optional purchases. What you buy is a limited, personal, non-transferable, revocable licence to use virtual items, currency, cosmetics, or account benefits inside the Game. You are not buying property, and you acquire no ownership interest.

Virtual items have no monetary value, cannot be exchanged for cash, and cannot be transferred outside the Game. They exist only within Primal and only for as long as the Game operates.

Prices are shown at checkout in the applicable currency and may change at any time. Purchases are processed by a third-party payment processor acting as the merchant of record; that processor issues your receipt and handles your payment details. Refunds are covered by our Refund Policy.

We may adjust, rebalance, or remove virtual items as part of normal game development. Game balance changes are not grounds for a refund.

4. Content and conduct in chat

You are responsible for what you post in game chat, on our Discord, and anywhere else connected to the Game. We may moderate, remove, or retain communications for safety and moderation purposes as described in our Privacy Policy.

5. Intellectual property

The Game client, server software, artwork, and original content we create remain our property or that of our licensors. These Terms grant you a personal, non-exclusive, revocable licence to use the client to play the Game, and nothing more.

Primal is an independent project. It is not affiliated with, endorsed by, or sponsored by Jagex Limited. All third-party trademarks remain the property of their respective owners.

6. Availability

We aim to keep the Game running and available, but we do not guarantee uninterrupted access. Servers may go down for maintenance, updates, or reasons outside our control. We may modify or discontinue features, and we may ultimately close the Game. Where a closure is planned, we will give as much notice as we reasonably can.

7. Disclaimers and liability

The Game is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.

To the fullest extent permitted by law, our total liability to you for any claim connected to the Game is limited to the amount you paid us in the twelve (12) months before the claim arose. We are not liable for lost progress, lost items, or indirect or consequential losses.

Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

8. Changes to these Terms

We may update these Terms. Material changes will be announced in game, on this website, or on our Discord. The “Last updated” date above reflects the most recent revision. Continuing to use the Game after a change takes effect means you accept the revised Terms.

9. Governing law

These Terms are governed by the laws of the United States and the state in which Primal Defense LLC is registered, without regard to conflict-of-laws rules. This does not deprive you of the protection of mandatory consumer protection laws in your country of residence.
